Judicial Panel Concurs to Reconsider Legal Matter
The federal appeals court ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an larger group of 11 judges. The court also vacated a previous decision from a three-judge panel that had sided with the federal government.
Legal Saga Over Military Presence
This order represents the most recent development in a long-running court case over whether the administration has the authority and valid reason to send national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was initiated in due to ongoing demonstrations.
Conflicting Arguments
The federal government has argued that government employees at the ICE facility in the southern part of the city were facing threats, while local authorities assert that municipal police have command of the circumstances.
In defiance of descriptions of the city as a conflict zone, residents have been posting videos of scenic paths and a vibrant culinary culture, and planning events such as an protest bicycle event against the increased military presence.
Court Proceedings
The Tuesday ruling came after a federal judge in the city enacted two legal injunctions this month – one preventing the federalization of the state troops, and another prohibiting the deployment of any national guard troops in the state, after attempts to evade the first order by mobilizing troops from California.
On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

The Tuesday decision means the matter will be heard by the full court – with all decisions under review together – by a panel of 11 judges.
“This decision demonstrates that the truth matters and that the courts are striving to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the state attorney general in a statement.
“The judicial body is sending a clear message: the president cannot dispatch the armed forces into US cities without cause. We will continue defending state legislation, principles, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
